Legal Warning to All States Hosting US Bases (Europe & GCC):

All countries that allow their territories, or US military bases located therein, to be used to carry out Trump's illegal orders to commit war crimes against Iran will be complicit in the crime under international law.

European leaders whose States are Parties to the Rome Statute of the International Criminal Court face personal criminal liability.

Article 25(3)(c) of the Rome Statute establishes individual responsibility for those who, “[f]or the purpose of facilitating the commission of such a crime, aid, abet or otherwise assist in its commission or its attempted commission, including the provision of the means for its commission.”

Official capacity provides no immunity (Article 27).

They have been clearly and publicly alerted to Trump’s plan to commit war crimes, leaving them no excuse for failing to take preventive measures.

All countries hosting US bases must publicly declare, beforep any operation begins, that they will not allow their airspace, territorial waters, or sovereign territory to be used in the commission of war crimes by the United States.

بیانیه وزارت امور خارجه درباره مواضع اصولی جمهوری اسلامی ایران راجع به امنیت و ایمنی دریانوردی در #تنگه_هرمز

جمهوری اسلامی ایران، به‌عنوان دولتی مسئول و پایبند به اصول منشور ملل متحد و حقوق بین‌الملل، همواره اصل آزادی کشتیرانی و امنیت و ایمنی دریانوردی را محترم شمرده و در طول سالیان متمادی ب��ای پاسداری از این اصول در پهنه‌های دریایی منطقه، از جمله خلیج فارس، تنگه هرمز و دریای عمان، کوشیده است. بدیهی است احترام به این اصول در عمل، از جمله عبور از تنگه هرمز، جز در پرتو احترام به حاکمیت و حقوق حاکمیتی دولت ساحلی، قا��ل تصور نیست.

متعاقب تجاوز نظامی آمریکا و رژیم صهیونیستی علیه ایران از روز ۹ اسفند ۱۴۰۴ (۲۸ فوریه ۲۰۲۶)، که ناقض صریح بند ۴ ماده ۲ منشور ملل متحد و قاعده آمره منع توسل به زور است، وضعیتی خطرناک بر منطقه خلیج فارس و تنگه هرمز تحمیل شده که آثار آن به‌طور مستقیم ایمنی و امنیت دریانوردی و کشتیرانی را نیز تحت تاثیر قرار داده است.

جمهوری اسلامی ایران در راستای اعمال حق ذاتی دفاع مشروع علیه طرف‌های متجاوز، علاوه بر هدف قرار دادن پایگاه‌ها و امکانات نظامی آمریکا در منطقه، مجموعه تدابیری را برای اطمینان از عدم سوء استفاده متجاوزان و حامیان آنها از تنگه هرمز برای پیشبرد اهداف تجاوزکارانه خود علیه ایران اتخاذ نموده است. جمهوری اسلامی ایران به عنوان دولت ساحلی تنگه هرمز، وفق اصول و قواعد تثبیت‌شده حقوق بین‌الملل، از تردد شناورهای متعلق یا مرتبط با طرف‌های متجاوز و مشارکت‌ک��ندگان در تجاوزات آنها ممانعت به عمل آورده است.

همزمان جمهوری اسلامی ایران در رویکردی مسئولانه، به منظور جلوگیری از تحمیل خطرات مضاعف بر کشتی‌ها و دریانوردان در خلیج فارس، تنگه هرمز و دریای عمان، مجموعه‌ای از تدابیر احتیاطی اتخاذ کرده است.

بر این اساس و همانطور که بارها تصریح شده است، تنگه هرمز مسدود نیست و تردد دریایی در تنگه هرمز متوقف نشده است. دریانوردی در تنگه هرمز با رعایت تدابیر ضروری اتخاذ‌شده فوق‌الذکر و ملاحظات ناشی از وضعیت جنگی ادامه دارد.

تاکید می‌شود شناورها، وسایل و هرگونه ظرفیت‌های متعلق به طرف‌های متجاوز یعنی آمریکا و رژیم صهیونیست��، و دیگر مشارکت‌کنندگان در این تجاوز، واجد وصف عبور و مرور عادی و غیرمتخاصم نبوده و در چارچوب وضعیت حقوقی ناشی از مخاصمه، وفق تصمیم‌ها و تدابیر مراجع صلاحیت‌دار ایران با آنها برخورد خواهد شد.

کشتی‌های غیرمتخاصم یا متعلق و مرتبط به سایر کشورها، مشروط به آنکه در عملیات‌های تجاوزکارانه علیه ایران مشارکت یا همکاری نداشته باشند و مقررات و تدابیر ایمنی و امنیتی اعلامی را رعایت کنند، در هماهنگی با مراجع صلاحیت‌دار ایران، می‌توانند از عبور و مرور ایمن در تنگه هرمز  بهره‌مند شوند.

بدیهی است مسئولیت هرگونه اختلال، ناامنی و خطر فزاینده در این آبراه و منطقه پیرامونی آن، مستقیماً متوجه رژیم آمریکا و رژیم صهیونیستی است که با تحمیل جنگی غیرقانونی و جنایتکارانه علیه ایران، امنیت و ثبات منطقه و نیز ایمنی و امنیت کشتیرانی بین‌المللی را در معرض تهدیدی بی‌سابقه قرار داده‌اند.

وزارت امور خارجه جمهوری اسلامی ایران بار دیگر تأکید می‌کند که هرگونه ترتیبات، ابتکار یا سازوکار مرتبط با ایمنی و امنیت کشتیرانی در خلیج فارس، تنگه هرمز و دریای ع��ان باید با رعایت کامل حقوق و مصالح دولت جمهوری اسلامی ایران، در هماهنگی با مقامات صلاحیت‌دار ایران، و با در نظر گرفتن واقعیت‌های ناشی از تجاوز و وضعیت مخاصمه انجام شود. بدیهی است بازگشت کامل امنیت و ثبات پایدار به این تنگه، مستلزم پایان دادن به تجاوز نظامی و خاتمه تهدیدات، توقف اقدامات بی‌ثبات‌کننده رژیم آمریکا و رژیم صهیونیستی، و احترام کامل به منافع مشروع ایران است.
