आरक्षण की समीक्षा और उसकी माँगों पर बात करने के लिए, दिखावे के लिए ही सही, इस सरकार के सलाहकारों की मूर्खता देखिए कि उन्होंने एक ब्राह्मण मंत्री @JPNadda को आगे किया है।

जहाँ माँगों में 'उपवर्गीकरण' एक प्रमुख माँग है, वहाँ भील, मुसहर, बाल्मीकि, लोहार, घुम��तू आदि जातियों के नेताओं के ��ल को आगे करना क्या उचित नहीं रहता?

ये लोग एकदम ही नहीं सोचते कि ऑप्टिक्स कैसा रहेगा? मुझे क्या, मैंने तो माँग पत्र दे ही दिया है, अब इन्हें जो करना है करें!

क्या UP सरकार ने हाई कोर्ट में अपने ही द्वारा दिये गए Undertaking का उल्लंघन किया है?

UP में 91% आरक्षण का मामला - तथ्य:
1. UP के 4 मेडिकल कॉलेज (अंबेडकर नगर, कन्नौज, जालौन और सहारनपुर) में 91.76% आरक्���ण लागू किया गया था।
SC=72.94%
ST=5.88%
OBC=12.95%
UR=8.24%

2. इस आरक्षण व्यवस्था को 2025 में इलाहाबाद हाई कोर्ट में चुनौती दी गई।
सरकार ने तर्क दिया कि ये चारों मेडिकल कॉलेज Special Component Plan (SCP) के तहत बनाए गए हैं, जिसका उद्देश्य अनुसूचित जाति के लिए विशेष प्रावधान करना था। इसलिए SC के लिए अधिक आरक्षण दिया गया।

3. इलाहाबाद हाई कोर्ट की सिंगल बेंच ने सरकार के इस आदेश को रद्द कर दिया और कहा कि आरक्षण की सीमा को इस तरह नहीं बढ़ाया ज�� सकता।

4. इसके बाद UP सरकार ने सिंगल बेंच के फैसले के खिलाफ अपील की। जस्टिस राजन रॉय और जस्टिस मंजिव शुक्ला की डिवीजन बेंच ने मामले की सुनवाई की।
डिवीजन बेंच ने उस समय आरक्षण के मूल विवाद पर अंतिम फैसला नहीं दिया। चूंकि 2025–26 में एडमिशन की प्रक्रिया पूरी हो चुकी थी, इसलिए उस साल की पुरानी सीट व्यवस्था को जारी रहने दिया गया।

5. UP सरकार ने हाई कोर्ट में Undertaking दी कि 2026–27 के शैक्षणिक सत्र से सही और कानूनी आरक्षण व्य���स्था लागू की जाएगी।
लेकिन 2026–27 में सरकार ने फिर वही पुरानी सीट व्यवस्था लागू कर दी है।

अब सवाल ये है कि अगर हाई कोर्ट में उत्तरप्रदेश सरकार ने खुद Undertaking दी थी कि 2026–27 से सही आरक्षण व्यवस्था लागू की जाएगी, तो फिर पुरानी 91% आरक्षण व्यवस्था को लागू करना, उस Undertaking का उल्लंघन क्यों न माना जाए?

सामाजिक न्याय के नाम पर समान अवसर और संवैधानिक संतुलन की उपेक्षा स्वीकार्य नहीं।

UP Govt Breaches Its Own High Court Undertaking?

91% Reservation in 4 UP Medical Colleges:

• 91.76% reservation was implemented (SC 72.94%, ST 5.88%, OBC 12.95%, UR just 8.24%).
• Allahabad HC quashed it, holding that the 50% ceiling cannot be breached.
• The Division Bench allowed the old matrix only for 2025–26, as admissions were already completed.
• The UP Govt undertook to follow the correct reservation matrix from 2026–27.
• Yet, the same old seat arrangement has reportedly been restored for 2026–27.

If the Govt gave an undertaking before the High Court, how can it go back on its own undertaking?

UP Govt Breaches its Undertaking in High Court?

Facts of the 91% Reservation Matter in UP:
-4 medical colleges in UP (at Ambedkar Nagar, Kannauj, Jalaun and Saharanpur) have implemented 91.76% reservation (SC 72.94%, ST 5.88%, OBC 12.95%, UR 8.24%).

-This was challenged in Allahabad High Court in 2025.
Govt argued that these 4 colleges were established under SCP (Special Component Plan) for Scheduled Castes, so more reservation for them.

-Allahabad High Court (single bench) quashed this order and said that 50% cap can’t be breached.

-The UP Government appealed the single-judge judgment. A Division Bench comprising Justice Rajan Roy and Justice Manjive Shukla heard the appeal. The Division Bench did not finally decide the underlying reservation question at that stage but allowed old reservation matrix for current year (2025-26) as admissions were already completed.

-UP Govt gave an undertaking that it would follow correct reservation matrix (in 2026-27 academic year).

-However, in 2026-27 academic year, the State has restored the same old seat arrangement, that potentially amounts to a breach of the undertaking on the basis of the order itself.

If govt is giving 91% reservation because the colleges were made with SC/ST budget,
Then appoint 91% teachers & staff also from reserved category.

And can we expect separate colleges for GCs too, from their budget?
Oh wait, but GCs have NO SPECIAL BUDGET for them!!
