1. القرار 2254 صدر بوجود النظام، وعرقل الأخير تطبيقه. وقد فقدت بنود كثيرة في القرار مفعولها بعد سقوط النظام. لم يعد ثمة دور لما يسمى المجتمع الدولي في نقل السلطة، لأن النظام انهار، وأمسكت بالسلطة قوة ثورية مسل��ة. في ضوء هذه الحقيقة الساطعة سطوع الشمس يفقِد بيان العقبة الختامي معناه أيضا. فماذا تبقى من قرار مجلس الأمن؟ ما تبقى هو حاجة القوة التي تمسك بزمام الأمور في دمشق حاليا إلى لقاء الشرعية الثورية مع شرعية قانونية ما تنظِّم عملها في بداية الطريق. من الضروري وجود قواعد ما تنظم المرحلة الانتقالية. فلا تنظَّم هذه المرحلة بمراسيم من دون مرجعية، وبحيث تشمل هذه المرجعية الهدف المراد الوصول إليه.
2. يجري ذلك من خلال الإرادة الطوعية للقوة المسلحة الحاكمة من دون تدخل خارجي، لأن ثمة هدف تريد تحقيقه (أهداف ثورة سوريا التي انطلقت في آذار/ مارس عام 2011، وهي اساس الشرعية الثورية أليس كذلك؟)، كما أن لديها ظرف إقليمي ودولي تريد تجاوزه (عقوبات وغيرها).
3. يمكن أن تشمل الحكومة الانتقالية أطرافًا سياسية متعددة، كما يمكن أن تشكل حكومة تكنوقراط لضمان الاستجابة لحاجات المجتمع والدولة، وسرعة التنفيذ. ولكن لا يضع الدستور تكنوقراط من القانونيين ولا يطرح للاستفتاء قبل أن تناقشه وتتوافق عليه القوى الاجتماعية والسياسية المؤيدة لعملية الانتقال. يمكن ان يعمل قانونيون على صياغة التعديلات والاقتراحات، اما مصدر هذه التعديلات والاقتراحات ومكان إقرارها فهو الحوار السياسي والمجتمعي على بنوده. ويكون إقرار المسودة في جمعية وطنية تـأسيسة يشارك فيها الجميع. أما استفتاء الشعب على الدستور بأكمله بنعم أو لا، فيأتي فقط بعد ان نوقشت بنوده بندًا بندًا وصوت عليها (بالإجماع أو بأكثرية غير عادية) في جمعية تأسيسية، وسجلت الاعتراضات والتحفظات.
4. إذا كانت ثمة حاجة ملحة لملء الفراغ الدستوري يمكن العودة إلى دستور عام 1952 مؤقتا إلى حين صدور دستور جديد.
5. في ظل وحدة الأرض والشعب والقوات المسلحة وسيادة القانون تتنوع المشارب والآراء والتيارات ويحترم هذا التنوع مثلما تحترم حقوق المواطن وحرياته.
