WOMEN AND YOUTH QUOTAS IN ELECTORAL AMENDMENT BILL WILL BE IN AUGUST POLL AS CONSTITUTIONAL PROVISIONS
Whereas in terms of section 157(5) of the Constitution of Zimbabwe, the Electoral Amendment Bill before Parliament is no longer relevant or applicable to the 23 August 2023 harmonised general election, following the proclamation of the election gazetted today before the Bill became law, some of the key provisions of the Bill arising from constitutional amendments promulgated in 2021 โ relating to women and youth quotas for which primary elections have been held โ are most certainly going be implemented in the forthcoming elections on the basis that they are provided in the Constitution, the supreme law of the land.
As such, the following is likely to happen regarding some of the Bill's key or hotly debated clauses:
Clause 2(b) which proposes to stop the use of driver's licences as proof of identity by persons who register as voters and who obtain ballot papers at polling stations will not apply to the 23 August 2023.
The essence of Clause 4 which deals with the continuation of the election of 60 women by proportional representation to the National Assembly under a party-list system will be done in the August election as a constitutional provision.
The import of clauses 4, 5 and 6 regarding the election of 10 youth members to the National Assembly a s per section 124(1)(c) of the Constitution as amended in 2021 is obviously a big one, not least because primary elections for these proportional representation seats have been held, and so the reason for the clauses will be effected in the August election on the basis of the Constitution.
And the logic of parts of clauses 4, 5 and 6 providing for the election of women on a party-list system to provincial councils and local authorities under section 277(4) of the Constitution as amended should also be implemented in the forthcoming election on the basis of the Constitution save that there's some doubt because primary elections have not been held for provincial councils, however, they maybe still be held in time for the Nomination Court on 21 June 2023.
Clauses 7 and 9 that propose to prevent persons who have been convicted of certain offences from being nominated for election will not apply to the 23 August election.
And lastly, clauses 8 and 10 that seek to set a time-limit for the withdrawal of constituency candidates will not apply to the eagerly awaited harmonised general election to be held on 23 August 2023.
Below is a copy of the Electoral Amendment Bill which has been overtaken by the election proclamation gazetted today, and will not apply to the 23 August 2023 harmonised general election, even if it passed by Parliament and is signed into by law by the President from today!
