Why the SEC will NOT appeal the Ripple lawsuit…I don’t have firsthand knowledge of this case but can tell you how these cases work. The “bosses” at the SEC care about “optics”.
They can parade this around as a victory with the $125 million dollars penalty. They can do press conferences and talk tough about how they’re making a difference and holding people accountable.
They currently have $125 million dollars on the table and if they lose on appeal they’ll lose that money and the optics that come with it. All those people care about is how this looks on their resume and will it get them the next promotion. If they appeal and lose, they not only lose the case but they lose any money and chance of career advancement.
Right now, even though they have lost on everything that has merit, they can declare it as a huge win with major penalties recovered. That’s why this case is effectively over. They will likely wait until the last day to “decide”.
