The new 2024 Federal Sentencing Guideline Amendment proposals are out. Unless disapproved by Congress, they will go into effect on November 1.
Big change to use of acquitted conduct at sentencing. The judge should no longer consider acquitted conduct unless the conduct also establishes the the offense for which the person is being sentenced. So if there is overlap between the acquitted conduct and the offense of conviction, the judge can still consider it.

Plaintiffs are correct, the law is unconstitutionally vague. "Inspected," is an essential element of the crime, but state law does not define "inspected" and neither does federal law. Choose your words more wisely when drafting criminal statutes.
