Solar and wind developers will do anything to make sure their contracts aren't shared or discussed online. That's why they all include gag orders.
I received this Flat Creek Solar contract that the landowner opted not to sign.
Of all the horrifying clauses in this contract, I need you to sit, specifically, with this one: "Developer shall have the right, at its option, to further extend the Term for three additional periods of five (5) years (each, a Renewal Period) following the expiration of the Operating Period."
Here you have a contract that admits to 5-years of evaluation, 25-years of operating, and now 15 additional years (not defined) if the developer so chooses.
That comes to a 45-year lease... of our prime farmland to foreign renewable corporations.
The panel manufacturers assign a 12-15 year warranty for the panels. Anyone who has lived by a commercial solar complex, especially in a climate where our winters sit below freezing for months at a time, including hail storms, ice storms, blizzards, and in Western New York, Lake Effect Snow and tornados, knows that these panels, if there are no natural disasters, will last MAYBE 12-years out in the open.
So why do these foreign companies need our land for 45-years?
What comes AFTER the solar complexes?
Since the panels will only generate at 12-15% of their annual potential in our climate (a 100MW solar facility will realistically generate 12-15MW of power per year), this isn't a fix for our grid.
These companies know that. That's why the contracts are shockingly one-sided and threatening.
Why do they need our prime farmland for almost 50-years?
These are questions anyone with an ounce of common sense should be asking themselves today. This is foreign interference in our country under the guise of "clean" energy.
You heard the man! @johnrich is putting his boots on the ground here in Upstate NY soon. A fight for the ages is brewing.

There is NO legitimate explanation for why anyone would even propose something this destructive, let alone push it forward, without somebody benefiting behind the scenes.
New York’s farms, open land, and natural beauty are some of the last great things this state still has.

I have been talking about this exact issue for a long time. There will be no more pilots for these signed by me. We are exploring all options to stop these.
We will rue the day these monstrosities were ever allowed. When these panels decay, and they will.... it will be a disaster.
@KathyHochul has very carefully appointed climate extremists to the Adirondack Park Agency board to push through environmentally catastrophic projects that would’ve never been allowed in the Adirondack Park before the Climate Act.
This is intentional.
They are giving our best farmland and water sources to foreign corporations under the guise of “green energy” in Upstate NY.
What happened to “Forever Wild?”
The land will never be farmed again.
Silver, cadmium, sometimes lead, microplastics, and zinc leach off the panels onto the soil below them.
One hail storm, blizzard, or tornado and glass shards will coat the earth below the panels.
That’s why potato growing associations nationwide won’t grow potatoes on former solar complexes.
They’re taking our best farmland for renewable energy credits and deals with foreign corporations.
This is why solar complexes create heat islands.
They are actually warming the areas where they claim they’re “fighting climate change.”
This has never been about saving the climate. It’s always been about green energy subsidies, credits, and back door deals.
So how come the @NYSDEC is ignoring emails about active eagle nests? About endangered species?
Didn't the DEC used to be an agency that acted aggressively and swiftly when they were made aware of a corporation destroying sensitive nesting sites?
They used to be, more or less. The prior commissioners of the DEC came from environmental backgrounds, including environmental law and conservation advocacy.
It all changed with Amanda Lefton, who was very strategically and purposely appointed DEC Commissioner by Governor Kathy Hochul.
Amanda Lefton is none of those things. She is, proudly and publicly, a climate policy figurehead. To Lefton, the "climate" comes before the physical environment, species, waters, and soils of this state.
Her resume is a departure from all prior commissioners in that it's littered with climate mitigation policy, offshore wind expansion, interagency energy planning, and implementation of large-scale decarbonization goals.
Before returning to NY, she served in the Biden administration as Director of the Bureau of Ocean Energy Management (BOEM). Her REAL interest is in offshore wind leasing and permitting. During her time working with @JoeBiden, she undoubtedly made connections with foreign wind developers who want green energy subsidies and credits.
Her most qualifying attribute that made her a top contender to @KathyHochul is that she brought wind turbine partnerships with her into the DEC.
How can an individual with a background in furthering offshore wind, renewable energy buildout, and configuring policy that makes it easier for corporations to steamroll local zoning and home rule... be an unbiased DEC Commissioner?
The answer is simple: it's not possible. Lefton is captured by the industry she's supposed to regulate at the top of the DEC. When foreign developers purposely skew environmental assessments that ORES allows them to purchase, downplaying take rates, animal deaths, and environmental poisoning, the DEC is supposed to step in on behalf of the environment.
Lefton was installed as part of a much bigger picture to push a made-up climate agenda on New Yorkers in exchange for control, generational land, and the destruction of our home rule.
Lefton has violated her oath of office as DEC Commissioner and has turned her back on this state's constitution. That's exactly what our current governor wants.
There is power in understanding WHO is behind the environmental mutilation in New York today. Lefton is a critical piece of the puzzle, ensuring the DEC looks the other way while ORES gives solar and wind corporations unchecked access to our grasslands, wetlands, farmland, and aquifers.
