As the raging battle continues between the family of Rosemary Chemutai Koech Kimwatu and her estranged husband Kevin Migwe Kimwatu over who should bury her body, Official court documents have revealed that Rosemary did not list her husband with her employer Kenya Commercial Bank(KCB) as her official next of Kin. She instead enlisted her sister Judy Koech Oyamo and her eldest son Charles Migwe Kimwatu. Mr Kevin only came to realise this on 26th August 2026 when he went to Lee Funeral Home to organise burial arrangements. This is when mortuary staff showed him an official letter from KCB Bank dated 25th August signed by head of shared Services, Risk Compliance and governance strictly authorising Rosemary's sister and son together pick her body and NOT her husband. It is this letter that prompted her husband to move to court to challenge it's legality and how a letter from the employer can inhibit a spouse from collecting his wife's remains under the Kenyan constitution 2010. He claims that since his wife died on 21st August, her parents have completely keep him in the dark as far as the funeral preparations are concerned. He claims that they were legally married for 13 years and together they have four children hence he has all the rights to dictate where the burial takes place . He is also accusing KCB Bank of trying to interfere with his family. The court granted him orders stopping the burial and maintaining status quo pending hearing and determination of the matter.
