We have heard, and shall, no doubt, continue to hear, extra-judicial seminars about the dissent and free speech, but words are cheap, actions count, and the actions are clear for all to see.
Finally, it is worth noting that this case was assigned to this bench by the master of the roster, i.e., the present CJI. We have discussed before how, because of their absolute powers over the roster, Chief Justices bear significant responsibility over what their Courts do.
This judgment further entrenches the SC as the Executive Court of India, notwithstanding the protestations of an ex-CJI at the “conclave” last week: it is a court that acts as an extended arm of the executive, and not as a protector of civil rights.
The judgment in Arup Bhuyan had understood the simple point that the word “membership” is so broad and vague that State can make completely baseless allegations and keep people in jail for years without trial. So they established a higher threshold. Now that protection is gone.
Today, the SC has given one of the worst and most damaging civil rights judgments in its history.

Boggled by this. Defamation law 101 is that references to a generic class of persons are not actionable unless an individual can show a direct reference to *themselves.*
