@MigaiAkech Then, can parliament decide what is an infringement of the constitution, as in gross violation of the constitution? My opinion is that it is the prerogative of the high court. Did the @rigathi team drop the ball?
@BiancaNaom1 The court should have addressed itself to the evidence and the parliament usurping the constitutional prerogative of the high court to decide what is constitutional, what is not constitutional and violations of the constitution. A Frankenstein monster eating its own.
The same bench lifted the conservatory orders, affirming it had the power to remedy any resulting harm. Today it has said it can't undo an impeachment.
@ahmednasirlaw The Gachagua judgment is like a court finding that an election was conducted in violation of the Constitution, awarding damages to the losing candidate, but refusing to nullify the election.
The logic is difficult to follow.
@ahmednasirlaw What is constitutional or unconstitutional can only be decided by the high court. Same for gross violation of the Constitution. Not parliament. It is down there with parliament sentencing one to jail.
