The enactment of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act of 2010 marked a paradigm shift in the governance of Nigeria’s energy sector. For decades, the industry relied heavily on foreign expertise, leaving local professionals on the fringes of highly technical operations. At the heart of reversing this trend is the "First Consideration" mandate, a statutory directive that forces oil and gas operators to prioritize Nigerian citizens for employment and professional development.

This framework transitions local capacity building from a voluntary corporate social responsibility initiative into a strict legal obligation.

The Legal Architecture of First Consideration

The operational core of the human capital directive is anchored in Sections 28 through 35 of the Act. Rather than serving as vague guidelines, these sections outline enforceable rules monitored closely by the Nigerian Content Development and Monitoring Board (NCDMB).

1. The Statutory Right to First Preference

Section 28(1) explicitly dictates that Nigerians must receive the first consideration for employment and training opportunities across all projects executed within the domestic oil and gas value chain. Operators cannot open recruitment or training cohorts to expatriates unless they document an absolute deficit of qualified local candidates.

2. Mandated Employment and Training Plans

Under Section 29, operators must submit a comprehensive Employment and Training Plan for every project. This plan acts as a regulatory blueprint, requiring:
A detailed breakdown of the skill sets needed for the project phases.
An explicit analysis of known shortages within the domestic labor market.
Anticipated training budgets and timelines to close those specific competency gaps.

3. Total "Nigerianisation" of Junior Roles
While intermediate and managerial ranks require deliberate prioritization, Section 35 leaves no room for ambiguity regarding lower-tier roles. It mandates that 100% of junior and intermediate cadres must be occupied entirely by Nigerian citizens. International contracting firms are legally barred from flying in expatriates for welding, fitting, or basic mechanical positions if domestic workers are available.

Succession Planning and the 4-Year Expatriate Understudy Rule
Recognizing that specialized subsea engineering or high-tech reservoir management roles may initially lack local hands, the Act permits temporary expatriate quotas. However, it pairs this allowance with an aggressive localization strategy under Section 31.
For every approved expatriate position, the operator must present a clear succession plan. At least two local professionals must understudy that expatriate. Within a strict maximum period of four years, the knowledge transfer must conclude, and the role must become fully "Nigerianised". To protect investor interests, companies are allowed to retain a maximum of 5% of management slots for foreign executives, provided it is approved by @OfficialNCDMB .
