🚔Trooper mistakenly believes he can arbitrarily seize and run the serial number of any gun he comes across.

Maryland State Trooper Che Smalls pulled a driver over for illegal window tint.

The driver had a valid Maryland concealed-carry permit and a legally owned firearm visible in the center console.

Smalls spots it through the window.

Smalls told him not to reach for it, then opened the door and seized the gun—not for immediate safety, but to run the serial number “to make sure it aligns with the permit.”

The driver immediately objected: the stop was for tint, entering the vehicle and running the serial was outside the scope and a Fourth Amendment issue.

Smalls initially insisted it was lawful, then appeared to reconsider.

No arrest was made over the firearm.

The encounter is an example of a routine traffic stop being extended to investigate a permitted gun.

🔹For the officer's safety they can justify temporarily securing a visible firearm. Running the serial number as a separate check during a tint stop is the disputed part.

❓Why the fishing expedition trying to find a violation of some law, ANY law.
