Earlier this year, in Parliament, I asked the then Minister of Police, Senzo Mchunu, whether he would commit to an open investigation into the continued employment of family members of Richard Mdluli in SAPS.

The Minister immediately said yes and confirmed that he will cooperate with the Portfolio Committee on Police.

This was a positive development but nothing happened after that. In fact, several of the said family members are STILL in SAPS.

Background on Mdluli’s Family Appointments in SAPS:

It is well-documented that General Richard Mdluli, former Divisional Commissioner of Crime Intelligence, appointed several family members within SAPS without following due process. Many of these individuals were rapidly promoted, given covert vehicles, and received salaries supplemented by intelligence funding.

This issue was previously flagged in an Auditor-General report, which raised concerns over misuse of SAPS Crime Intelligence and Secret Service Account funds. Additionally, extensive evidence was presented at the State Capture Inquiry, detailing how Mdluli and his network abused state resources for personal benefit while obstructing accountability.

Notable irregular appointments and financial mismanagement include:

Family Members of General Mdluli Employed in SAPS CI

1.Busisiwe Mdluli (Daughter)

Studied in China while her travel expenses were covered through Secret Service Account funds. Travel was arranged through Westville Travel .

Accompanied General Mdluli on a trip to China on 06 November 2009.

Business Class flights were funded through the secret service account, despite the trip being personal.

The trip’s total cost was R110,000, with R60,000 from the secret service account and an additional R50,000 allegedly from Atlantis Motors via the “Barut account”.

Accompanied Mdluli on a trip to Singapore (21-28 Nov 2009).

She was not a SAPS member but worked as a clerk at the Department of Home Affairs.

Her Business Class flight ticket was paid for with secret service account funds (R46,809) .

Other Family Members Rapidly Promoted in SAPS

One family member was promoted from Constable to Lieutenant Colonel within just over a year.

Another relative was promoted from Admin Clerk to Colonel .

5.Unspecified Additional Family Members

Seven (7) agents related to Mdluli were appointed in early 2010, despite having no experience in crime intelligence or covert operations.

Their salaries were supplemented using secret service account funds .

These individuals received vehicles intended for covert operations, falsely registered under Crime Intelligence asset records .

6.Nkosana Ximba (Close Associate)

Promoted from Constable (Level 4) to Colonel (Level 12).

Failed to disclose a past criminal conviction and civil judgment in his application .

7.Nonhlanhla Portia Mdlalose (Sister of Ximba)

Appointed as a Level 5 Administration Clerk despite having no relevant experience.

Also failed to disclose a criminal conviction .

Criminal Investigations & Case Status:

•14 criminal case dockets were opened regarding these appointments.

•The cases were irregularly closed as “undetected” or “withdrawn”, and none were referred to the NPA for prosecution

Given the history of irregular appointments, mismanagement of SAPS funds, and obstruction of investigations, this matter demands full transparency and accountability.
