The Federal Government, through its Ministry of Finance, recently gazetted the Deduction of Tax at Source (Withholding) Regulations, 2024.
Its enforcement is set to commence on the 1st of January 2025. This regulation is poised at promoting the ease of doing business in the country; hence, let’s demystify what the concept of WHT is all about.
Withholding tax is a kind of tax that is deducted at the source of income before a party receives his payment. Thus, it is not paid directly by the recipient of that income; hence, the party paying for that service withholds a certain percentage of the total payment and remits it to the appropriate revenue authority.
For example, if Company A contracts Company B to deliver goods and the total cost of the transaction is 500,000 Naira, Company A deducts 10,000 Naira as tax and remits to the FIRS and pays Company B the sum of 490,000.
RATES
The rates for WHT differ based on the transaction. For example, the rate for resident professional, management, and technical services is pegged at 5%, while the tax rate for resident services supply of goods is fixed at 2%.
These rates can be found in the First Schedule of the 2024 Regulations.
