Last night, we filed our Initial Brief with the Third District Court of Appeal challenging the trial court’s rulings in the litigation against NASCAR. The appeal addresses, among other things, NASCAR’s written approval of the sponsorship, subsequent public statements denying that approval, and multiple legal errors we believe require reversal.
We remain committed to pursuing accountability and protecting the interests of the LGBcoin community.

After a week long trial, the jury ruled that we did reasonably rely on NASCAR’s sponsorship approval but (incorrectly) that we didn’t change our behavior on it. We are truly sorry we didn’t deliver justice at this trial but are committed to holding NASCAR accountable and will continue on appealing at least the defamation count (with the judge today even admitting we had good defamation damages). Thank you all for your support it means the world to us 🙏
With closing arguments scheduled for tomorrow, it’s time to finish the job! After Friday’s fireworks exposing massive credibility issues with NASCAR exec Eric Nyquist after his own employee Mike Forde ok’d the BMS press release as “being let’s go Brandon but they positioned it ok”, both Jerry Brown and Nyquist stating that Nyquist gave the example that Trump ‘24 was political but Trump Hotel wasn’t, and NASCAR’s expert threatening to physically attack @jameskoutoulas, it has been a hard fought week in court. NASCAR has already brought in a team of appellate lawyers to manage the end of trial but judge Lisa Walsh has presided over trial with extreme care to avoid appealable issues.
Thank you to @bobpockrass for sending NASCAR our press release 75 minutes before release. Where NASCAR exec Mike Forde agreed that it was “ok” that we were derived from “Let’s Go Brandon” contrary to testimony from NASCAR chief impact officer Eric Nyquist. Nyquist repeated 15 times that he supposedly said nothing that looks or smells like Let’s Go Brandon would be approved. But nyquist, a University of Chicago law school graduate admitted he never put that in writing or ever brought it up to anyone at NASCAR or BMS, who all said derivatives phrases were ok per Nyquist’s example that “Trump 2024” was not ok, but “Trump Hotel” was.
