Subject: Constitutional Expiry of Federal Mandates, Attempted Unlawful Extension of Executive Power, and the Imminent Risk to Stability, Security, and Democratic Order in Somalia
Mogadishu, Somalia - I issue this statement in my capacity as a Former Member of the Foreign Affairs Committee of the House of the People to address, in clear and unambiguous terms, the grave constitutional crisis now confronting the Federal Republic of Somalia.
As of April 14, 2026, the mandate of the House of the People has expired. By operation of constitutional limits, legislative authority cannot lawfully be exercised absent the full reconstitution of the Federal Parliament, including both the House of the People and the Upper House. Any claim to legislative continuity beyond this date, without a constitutionally compliant electoral process, is devoid of legal foundation and constitutes an unlawful assumption of authority.
The presidential term of Hassan Sheikh Mohamud is set to expire on May 15, 2026. This is a binding constitutional deadline. Any attempt - direct or indirect - to extend executive tenure beyond this date without a lawful electoral mandate constitutes a violation of the Constitution and an assault on the democratic order of the state.
Let there be no ambiguity: actions taken in contravention of these constitutional limits are not political disagreements; they are legal breaches that invalidate authority, undermine state legitimacy, and expose those responsible to domestic and international consequences.
This constitutional breakdown is occurring in parallel with the continued application of the United States national emergency and sanctions framework concerning Somalia, established under the International Emergency Economic Powers Act. That framework empowers foreign authorities to impose financial restrictions, asset freezes, and travel bans on individuals deemed to be engaged in corruption or actions that undermine stability. These measures operate independently of Somali judicial processes and are enforceable across the international financial system.
The convergence of an expiring constitutional order with an active external sanctions regime creates a volatile and dangerous environment. It introduces immediate risks to the continuity of governance, the legality of state actions, and the credibility of Somaliaโs institutions in the eyes of international partners. It also places individuals occupying positions of authority- particularly those involved in public finance, security, and natural resource management -under heightened exposure to external enforcement measures.
The implications for stability and security are severe. Somaliaโs security architecture and public service delivery remain heavily dependent on external financial support. Where constitutional legitimacy is in question, international partners are likely to reassess, condition, delay, or suspend funding. Any disruption in budget support or security financing will directly impact operational capacity, including the ability to maintain order, pay security forces, and sustain essential state functions.
The risk is not abstract. A contested or unlawfully extended executive mandate, combined with the absence of a functioning legislature, creates conditions for institutional fragmentation, parallel claims to authority, and escalation of political tensions. These dynamics increase the likelihood of confrontation between state-aligned forces and opposition actors, with potentially severe consequences for civilian populations.
It is further noted that the response of international partners has, to date, lacked the urgency and clarity required by the gravity of the situation. The absence of firm, coordinated action to uphold constitutional order risks being interpreted as acquiescence. Such inaction, in the face of clear constitutional violations and escalating risk, may amount to material and political complicity in the deterioration of Somaliaโs statehood, the erosion of its democratic order, and the potential descent into widespread conflict.
Accordingly, all international partners - including multilateral institutions, bilateral donors, and diplomatic missions - are hereby placed on formal notice that failure to act decisively and urgently to uphold constitutional governance in Somalia will carry consequences not only for Somalia, but for regional and international stability. Continued engagement, financial support, or political recognition extended to authorities acting outside constitutional limits risks legitimizing unlawful governance and exacerbating instability.
The trajectory toward May 15, 2026 represents a critical inflection point. If constitutional limits are disregarded and lawful processes are not respected, the probability of widespread unrest, including violent confrontation, will increase significantly. The risk of a breakdown in order, with consequences potentially exceeding the scale and devastation of the Somali Civil War, cannot be dismissed. The international community must not underestimate the severity of this moment.
Immediate action is required - not tomorrow, but now. Preventive engagement, clear legal positioning, and firm conditionality tied to constitutional compliance are essential to avert escalation. Delay will not preserve stability; it will accelerate collapse.
International partners are urged to align their actions with the principles they publicly uphold. Stability cannot be purchased through silence, nor can governance failures be ignored in favor of short-term convenience or insulated operational environments. The Somali people must not be abandoned to the consequences of inaction while external actors continue to operate unaffected by the unfolding crisis.
This statement is issued as a formal legal and political warning. The Constitution is not advisory. It is binding. The expiration of mandates terminates authority. Any continuation of power without lawful basis constitutes an illegal exercise of state authority and carries consequences under both domestic principles of accountability and applicable international measures.
The Somali people are entitled to governance that is constitutional, accountable, and legitimate. The preservation of stability, security, and democratic order depends on strict adherence to these principles. Failure to do so at this juncture will carry consequences that are immediate, far-reaching, and difficult to reverse.
