@peteharrar@mistressdivy Yes. The insurer takes that risk. And they gladly accept premiums for collision coverage to take that risk. They also enjoy the benefit of their insured’s deductible in the event of a collision with an uninsured at-fault driver before forking over one red cent.

@mistressdivy Hot take: Drivers who are involved in accidents shouldn’t have to pay back their Personal Injury Protection (“PIP”) funds at the conclusion of their case. PIP is not fault-based, and the insured pays a premium for it. It’s bullshit that it has to be paid back. Subrogation is rape
