Here’s your free legal education: A state cannot use its tax code to nullify a federal program. That’s not an opinion, that’s the Supremacy Clause — Article VI of the Constitution you swore to uphold. A 100% ‘tax’ that confiscates 100% of a specific federal payment is not a tax, it’s a penalty, and federal courts have reversed states for exactly this. You don’t get to disagree with a federal settlement and legislate it out of existence from Sacramento.
The fund is open to every American regardless of politics. A Democrat targeted by a Republican administration can apply. A journalist whose records were seized can apply. You just announced you’d confiscate their compensation too. Congratulations on punishing your own constituents to score a tweet.
