Based on CJEU's EncroChat ruling (C-670/22), I expect the court might decide that refusal to disclose hack methods violates fair trial rights (Art. 47 EU Charter) if it prevents defendants from effectively challenging evidence.

Yes, lack of transparency could render evidence inadmissible, especially if it has preponderant influence on the case.

This might lead to evidence exclusion, potentially causing dismissals or retrials in SkyECC/EncroChat cases, depending on national courts. Outcome remains uncertain until ruled.

As an update:

I contacted the guy who filmed it asking for specific location so I could try & get help but didn’t receive a response. But, based on the cafe in the background, I think it is Birmingham New Street (?)

So, I’ve contacted both the local police & also a wonderful charity called SIFA Fireside. The latter are going to pick it up. Hopefully they will find him & be able to help him. I’ve asked if they can provide me with an update, if & when possible…

Nobody deserves to be in this state. We have a duty to help each other…

I hope this guy gets the help he needs & that life turns around for him soon. Non of us know what is around the corner in our own lives and it is easy for things to spiral out of control...

A. 🍤 Stated Europol did not keep data for first week & didn’t record X3 data hash values.
B. The continuity of hash value files has never been established or verified.
