South African law can be incredibly confusing and counterintuitive. A 16-yeard old child has legal capacity to consent to sexual intercourse yet the same 16-year old remains a child for purposes of certain offense provisions

I learnt today that an adult, regardless of the age gap, can have a consensual sexual intercourse with a 16-year old but cannot ask that same 16-year old for sexually explicit material without potentially committing a separate sexual offence

Personally, I think the statutory age of consent should simply be 18 rather than having different threshold for different form of sexual conduct. The distinction may not be immediately obvious to the ordinary person
