The Senate Banking version of the #ClarityAct is on the floor. And it’s interesting to see how different it is from the Ag committee version. And, of course the House version.
Will they reconcile? Maybe.
Mostly I’m concerned with what they all miss.
👉We have to start addressing the fact that tokens are dynamic in nature, not static like every other asset.
Our regulatory structure doesn’t account for this - this will become more of a problem as quantum computing broadens makes more assets dynamic.
We need a regulatory structure that addresses what’s actually happening in blockchain- not just from the banking side, or as an integration on private chains.
👉If nothing here addresses the fundamental unfairness of the accredited investor rule and the mess and chaos that has become the retail token scene as a result, this entire regulatory process will have been a charade.
👉People drafting need to understand what is actually being built. If they did, they’d never call memecoins “not a security.”
Before everyone starts yelling “Howey” - the Howey test is one test for one part of a list of things that are sometimes securities, depending on facts and circumstances. It’s not the only list.

👉Congres needs to understand why, how communities work, what is happening with retail vs the ETFs and integrations of financial tools. The approach is either very finance heavy, weirdly consumer product driven (thanks, Elizabeth Warren), or treating it like it’s a standard securities issue with team and top-down disclosures possible.
None of this works as a whole.
👉Congress also needs to understand how the stablecoin issues and GENIUS Act actually impact the market and create both inflation and fraud.
We’re missing too much with these bills. They need to do better.
