The 2017 Lawsuit: Turning Point USA v. Grand Valley State UniversityBackground
Grand Valley State University (GVSU), a public university in Michigan, maintained a highly restrictive “speech code” and “free speech zone” policy until 2017. Under these rules:
Only 0.03% of campus (essentially one small plaza) was designated as a “free speech area.”
Students and student organizations had to obtain a permit at least 5 business days in advance to engage in any expressive activity (tabling, distributing literature, protests, etc.), even in outdoor areas.
The university reserved the right to deny permits or relocate events based on vague criteria like “safety” or “disruption of normal university operations.”
Non-students (outside speakers, invited guests) were almost never granted permission to speak or table.
The incident that triggered the lawsuit
In September 2016, members of Turning Point USA (TPUSA) at GVSU set up a table with a “Trump for President” sign and literature outside the free speech zone without prior permission. Campus police quickly shut them down and threatened disciplinary action. When the students tried to reserve space inside the free speech zone weeks later to host conservative speaker Christina Hoff Sommers, the university denied the request, citing concerns about “controversy.”The lawsuit
In December 2017, Turning Point USA and two GVSU students (represented by Alliance Defending Freedom) filed a federal lawsuit (Turning Point USA v. Grand Valley State University, Case No. 1:17-cv-01125 in the Western District of Michigan) claiming the policies violated the First and Fourteenth Amendments.Key claims:
The “free speech zone” limited speech to a tiny portion of campus.
The prior-restraint permitting system gave administrators unchecked discretion.
The policies were both facially unconstitutional and unconstitutional as applied to the students.
Settlement (announced May 2018)
Rather than fight the case, GVSU settled with the plaintiffs. The terms were very favorable to free speech:
GVSU completely eliminated its “free speech zone” policy. All outdoor areas of campus generally open to students are now open for expressive activities.
The university revised its facilities-use policy so that students and student organizations can reserve space with only 48 hours notice (and often same-day for small events).
Non-students invited by a registered student organization can now speak and table on campus under the same rules.
GVSU paid $37,500 in damages and attorneys’ fees.
The university agreed to mandatory First Amendment training for campus police and student-affairs staff.
