@tribelaw When lawyers make decisions based on politics rather than pursuing the facts and drawing legal conclusions from them (as they were taught in law school) they often make profound errors. Garland may be a great jurist but he's a piker when it comes to political judgments.
@AWeissmann_ In my experience, lawyers -- especially litigators -- are poor judges of what is or is not political. It's totally outside their expertise and, ironically, any thoughts they may have to the contrary results in poor decisions that are in themselves political. Poor judgment.

@lawofruby Trump's defenses, both factual and legal, would be subject to the doctrine of collateral estoppel. The only triable issue might be damages. She should consider seeking injunctive relief against Trump based on the final judgment.
