What these activities failed to understand is that, the blockade has been declared which follows the San Remo Manual (1994) on Naval Blockades. Israel had already set the geographic boundaries of the blockade on the Gaza Strip & most governments know it, even the Spanish government that was clearly trying to push this activities to violate this legally binding international treaty.
The Right of Access for Humanitarian Relief that is LINKED to the prohibition on starvation, to which Israel is abiding by, there is a legal obligation to allow the free passage of essential humanitarian supplies for the civilian population, including food and medical supplies, โSUBJECT TO A RiGHT OF INSPECTION BY THE BLOCKADING POWERโ in this case ISRAEL. This is explicitly stated in Additional Protocol I (Article 70) & is a key part of modern blockade law as reflected in the San Remo Manual(1994).
These activities are simply trying something that wonโt succeed as long as international treaties are concerned. Otherwise, I donโt think any country would want to change this treaty on naval blockades.
The tricky part here is that the Israeli government isnโt preventing aid delivery to Gaza through the sea. However, it would allow these aids to be delivered through designated ports where necessary inspections will be conducted to confirm that the cargoes being delivered are what they are said to be, purely humanitarian in nature & not weapons.
So, these activities could cry as loud as the want invoking humanitarian law but it want change the legality of this blockade as long as there is hostile military force in Gaza that threatens the national security of Israel & its citizens.
If they truly want to deliver aid to people in Gaza, they could have directly sailed to Ashdod port, where the aid could have undergone inspection & been handed over to the aid organisations currently operating there.
Instead, they wasted resources & energy, & are now likely to be categorised as Persona Non Grata. They will never set foot in Israel again for the rest of their lives.
