@Lis5718 At scenes, searches, and other instances of evidence collection, it is not uncommon for any exculpatory evidence to simply be ignored if it does not support the investigators preconceived narrative. This confirmation bias is in our nature as humans, we must remain diligent.

@TNCrimDefense I hope to see a day when case law rulings are extended to include evidence competent government actors should have known to exist and they willfully chose not to collect it. This happens all the time! ie…Pipes abandoned with a 1/4 ounce of meth to support only a resale charge.
One of the cruelest things about our criminal justice system is the bureaucratic indifference. One tiny piece of neglect or laziness by a gov't actor can absolutely F somebody's life.
The crime of DUI is dangerous and deadly. The weight placed upon this crime is heavy… thus requiring a specific investigative process to accurately make the arrest decision…if these fundamentals are not adhered the innocent are at peril.
