THE TSHUMA CASE: The Legal Clash of 2 Countries.
A British citizen is arrested in Joburg, accused of a horrific triple murder in the UK but he also has an illegal gun case in South Africa. Why isn't he being extradited immediately?
1/ The Jurisdictional Clash: SA Gun Charge vs. UK Murder Charge:
Tshuma was caught in Kensington with an unlicensed firearm (which SAPS suspects was for self-harm). Under SA law (Extradition Act 67/1962), when domestic charges are pending, extradition is usually stayed until local proceedings and sentences are concluded.
This means, technically, SA has the right to try him for the gun charge 1st which carries up to 15 yrs in prison.
2/ Will the NPA Fast-Track Him Anyway?
Yes, likely. The National Prosecuting Authority (NPA) can make a strategic decision to withdraw or postpone the local firearm charge to expedite the extradition.
Why? Because prosecuting a minor local weapon offense is vastly outweighed by bringing a suspected triple-murderer to justice in the UK. It’s a matter of international comity (cooperation between nations).
3/ The 40-Day Clock is Ticking
Right now, Tshuma is held under a Provisional Arrest Request sent via Interpol Manchester to Interpol Pretoria. Under SA extradition procedures, this is only a temporary hold.
The UK Crown Prosecution Service (CPS) now has 40 days to submit a formal, fully-documented extradition request containing the case dockets and evidence. If they miss this deadline, SA courts must release him from the extradition hold.
4/ The Strategic Bail Decision
Tshuma's defense team temporarily declined to apply for bail. This was a highly calculated legal move, not a surrender.
Given that he allegedly fled the UK on a British passport and is facing triple-murder charges, he is the definition of a flight risk. A bail application right now would be a guaranteed, costly loss. They are waiting to see what the UK formally submits first.
5/ Why this Extradition is easier than US cases
In SA law, we cannot extradite someone to a country where they might face the death penalty (following the landmark Mohamed ConCourt case), unless we get a written guarantee they won't be executed.
Because the UK abolished the death penalty decades ago, this massive diplomatic roadblock is entirely non-existent. Once the paperwork is verified on July 22, the road to sending him back is legally wide open.⚖️
They found a whole community of Illegal Somalians living in a gated communal area the size of a shopping centre with over 40 rooms in PMB KZN. Each room accomodates about 6-10 of them depending on how much they pay.
