The Fifth Circuit's decision to take abortion-by-mail off the table during the pendency of litigation was well-reasoned and thorough. The parties filed briefs in the SCT making various arguments. What's the rationale for the Court's decision to "stay" (cancel, essentially) the Fifth Circuit's order? The Court doesn't tell us.
As Justice Alito says in his dissent, abortion-by-mail is an end run around Dobbs, which restored the rights of the individual states to regulate abortion access within their borders.

Planned Parenthood claims to support women, yet its latest annual report reveals the truth. In 2024, Planned Parenthood broke its own record and performed 434,450 abortions. This number represents a profound loss of life and carries with it immeasurable grief and pain. While ending the lives of hundreds of thousands of little babies and harming women in the process, Planned Parenthood was also scaling back women’s healthcare services like cancer screenings, pap tests and preventive care.
Women deserve better. They deserve real support, meaningful resources, genuine compassion and authentic healthcare that empowers them, not a "fix" that puts their life on the line and ends the life of their baby.
At the March for Life, we are committed to fostering a culture that affirms the dignity of every human life. We will always stand with every woman and for every child, and we will not rest until abortion is illegal and unthinkable.
What today's DOJ report reveals about enforcement of the FACE Act during the Biden Admin isn’t pretty.
Biden DOJ worked hand-in-glove with pro-abort groups to monitor & track pro-life advocates, looking for any opportunity to criminalize their activity.
And DOJ took seriously inequitable approaches to sentencing for pro-life FACE Act defendants versus (many fewer) pro-aborts charged with attacking pro-life orgs: DOJ sought sentences over twice as long for pro-lifers.
This is deeply offensive.
