This really seems like a contractual dispute and I think Dunkin Donuts threw TM infringement in there just to bolster their claim (if not, they need some new contracts).
@Entrepreneur I do wonder how much of this blowback Facebook expected when they switched to Meta. That said, given the boon in litigation financing, I feel like someone would take up this case against such a deep-pocketed defendant like Facebook.
I love this idea! I think it could help remove a lot of subjectivity from the likelihood of confusion analysis. However, technological innovations working their way into the legal process is very slow and the tools have to be well-developed for them to be adopted.
Very much in support of Rogozinski and I hope he’s able to prevail here. Yes, Reddit had their involvement in helping build the brand, but given how many hurdles they’ve put in from of WallStreetBets to operate, them claiming TM ownership is disingenuous.
