The Pennsylvania Department of State (PA DOS), which is the state agency that administers elections, has a number of questions to answer about non-citizens on the voter rolls.
No county takes election security and integrity more seriously than Lancaster County, which in 2024 caught and stopped a major attempted voter registration fraud operation (more discussion below.) We continue to take our responsibilities extremely seriously and expect other agencies to do so as well.
Therefore, I hope PA DOS will answer the questions that are being raised about non-citizens on the voter rolls across PA. If they do not do so voluntarily, perhaps there are those in the media or Pennsylvania Legislature who would pursue these questions along with me.
First: why is PA DOS very quietly alerting counties by phone - and not in writing - that there are non-citizens or suspected non-citizens on the voting rolls? In Lancaster County, they called and relayed information via word of mouth and asked our staff to write it down while on the phone rather than simply sending an email or letter. I believe this is likely happening in other counties also.
Obviously, this makes record keeping more difficult and is not normal procedure for a state agency. Is this an effort to circumvent Right To Know laws and/or to avoid documentation of what is happening in Pennsylvania?
Is PA DOS now quietly taking action to clean up voter rolls because it is concerned about federal efforts to pursue all remedies to stop non-citizen voting? What do they know about overall numbers of non-citizens on PA’s voter rolls?
Second: why is PA DOS putting out pieces of information as if they are conclusive before the criminal investigation is complete? From a recent media piece discussing communication from PA DOS staff: “According to Communications Director Matt Heckel, that person filled out a paper application where they identified themselves as a noncitizen. Despite this, their voter registration was approved and they later cast their vote.” (Noncitizen faces penalties after casting vote in Lancaster County, state department says)
I do not know yet whether that statement is true. That is something that will have to be investigated and determined by the District Attorney’s Office, which we, the County, made a referral to - not PA DOS. Until we have the results of the criminal investigation, it is not appropriate to make conclusive statements of fact like that about exactly what happened.
Is it possible that a busy elections clerk at the desk accepted a stack of registration forms (as they are often brought in) and missed on one that an individual had identified themselves as a non-citizen? Certainly. It would be a very rare occurrence for someone to do that (identify themselves as a non-citizen), and it is possible the staff member missed it. But it is also strange that a self-identified non-citizen would be registering to vote and openly noting they are a non-citizen (who obviously is not permitted to vote.) Thus, it is important for the investigation to be conducted and the details to come out when it is complete.
What this looks like is an effort by PA DOS to deflect attention away from what appears to some to be a serious problem with the PennDOT Motor Voter Registration system, from where the other problematic registrations appear to have emanated.
One of the reasons I am skeptical about PA DOS claims, is because PA DOS has previously lied about and attacked non-partisan election workers in Lancaster County. In 2024 LNP and individuals at Franklin and Marshall college and the Secretary of the Commonwealth (who is the chief election official in PA) and the head of PA DOS seemed to be working together to generate a series of LNP articles suggesting County elections staff were disenfranchising college students, something that was demonstrably false. Our staff were actually very faithfully following the law and upholding basic election security measures.
One of the reasons it appears they were working together is because the County received a threatening letter from the Secretary of the Commonwealth Schmidt, but it was actually delivered by LNP – i.e. it appears LNP staff had the letter BEFORE the Secretary ever provided it to the County, demonstrating at least the appearance of coordination between these groups/individuals to generate false stories. This despite the fact that our Elections staff was fully aligned with the professional staff at Schmidt’s own Department about election procedures at the time, and despite the fact that Schmidt himself had spent years talking about how non-partisan election staff should not be attacked.
Despite these attacks and pressure, our elections staff did an outstanding job maintaining security and integrity of the election. In fact, that same year, in 2024, our team thwarted a large-scale attempted voter registration fraud operation. This was a very significant operation involving thousands of fake registrations forms across multiple counites. The staff under great pressure at the time given this was the biggest and most complicated election ever run to date and these registrations were dropped off just before the deadline, which is already very tight because of the law - meaning they could have just rushed and processed them rather than doing their due diligence. We then put this information out to the media because PA DOS did not alert other counties, as they should have, and as a result of our work the attempted fraud was stopped across PA.
Third: in another recent statement to the media, PA DOS said: "While instances of registration or voting by noncitizens are extremely rare, the Department takes seriously any allegations of unlawful registration. While counties are ultimately responsible for maintaining their voter rolls, whenever the Department becomes aware of evidence that someone has improperly registered to vote, it immediately notifies the affected county and, if appropriate, makes a criminal referral to law enforcement.” (Apparent 'non-citizen' was registered to vote in Lancaster County, Pa., board of elections says - WGAL)
The statement about counties being ultimately responsible for maintaining their voter rolls appears to be an attempt to shift responsibility. However, what PA DOS is not telling you, is that there is virtually nothing counties can do about registrations that arrive from the PennDOT Motor Voter program. Counties see very little information information on the voter. The program is run completely at PennDOT and/or PA DOS and the registration simply arrives at the county and the county has to essentially accept it.
So what is PA DOS doing to fix the apparent Motor Voter problems?
This is potentially a very significant issue across PA, especially if the PennDOT Motor Voter system is letting non-citizens register, which I believe is likely.
But this is also symptomatic of the entire PA election registration system that is basically an honor system without the systematic checks and balances that are needed to ensure only citizens can vote – i.e. the SAVE Act.
PA DOS also says “If appropriate” it “makes a criminal referral to law enforcement” but they did not appear to do so in the Lancaster cases. We made the referral to law enforcement.
So if PA DOS is not making criminal referrals, and these quiet notifications (deliberately not in writing) are happening elsewhere across the state, and I believe they are, who is making the necessary criminal notifications? Without them cases of voting fraud will not criinally investigated and prosecuted. They will just quietly go away.
In Lancaster County, the County Commissioners are pushing for them.
What about in counties where the leadership is not pro law and order and instead works with PA DOS to keep things quiet that there are, or were, non-citizens on the voting rolls?

During the Pennsylvania 2020 Election, over 1.8 million mail-in ballots were sent out, with over 1.4 million mail-in ballots returned. However, 2.5 million mail-in ballots were counted in the presidential election.
These figures were originally displayed on the Secretary of State's own website, which were then wiped to cover up the discrepancy in ballots and fraud. It gets even better...
22,686 mail-in ballots were returned the same day that they were mailed. 32,591 mail-in ballots were returned the day after they were mailed. And another 20,000 mail-in ballots were returned BEFORE they were ever even mailed. There were also 8,021 mail-in ballots submitted from dead people.
