We have filed an urgent direct appeal to the Constitutional Court to challenge the High Court’s interim interdict.

This order is appealable because it has a final effect on parliamentary processes, as supported in the case of National Treasury v OUTA (2012), which demonstrates that such interdicts can be set aside.

Currently, there is no court hearing to determine the lawfulness of this order - it is binding and creates a concerning precedent for executive accountability, thus rendering it appealable.

We are appealing based on three key issues:

1. Vagueness of the order: The interdict specifically targets "public impeachment hearings," which is open to different interpretations and creates significant legal uncertainty. A vague court order is invalid and unenforceable as it violates the rule of law - a key value in our constitutional order, as per section 1(c) of the Constitution. Additionally, if the public aspect of the impeachment inquiry is interdicted, it violates Section 59 of the Constitution, which mandates that the National Assembly conduct its business in a public manner.

2. Unrequested relief: The order granted is not what was prayed for in the President’s notice of motion. The President asked for an interim interdict on the impeachment inquiry itself, but the judgement orders an interdicting of "public" proceedings. A court is limited by the relief sought by a party in their pleadings and cannot grant an order beyond that which was specifically pleaded.

3. Practical effect of delays: The order effectively delays impeachment proceedings and frustrates the implementation of the Constitutional Court's directives in the Phala Phala case. When the President loses his review application, he will appeal, and further appeals will continue to restrain Parliament from fulfilling its obligations.

This cycle of appeals means it could take a minimum of two more years before accountability can be sought, leaving questions of serious misconduct and constitutional violations by the President unanswered , which is in direct conflict with Section 42(3) of the Constitution.
