Yesterday, Brazil’s Supreme Court Justice Alexandre de Moraes yesterday granted @jairbolsonaro temporary home detention for 90 days on medical grounds, after previously insisting prison conditions fully protected his health.
Moraes spends pages and pages arguing that the prison system fully protects Bolsonaro’s health with proper medical care, structure, everything working as it should. And yet, he concludes that Bolsonaro must be released because home detention is “more appropriate.” That doesn’t hold. Either the system works, as he claims, or it doesn’t. It can’t be both.
There’s another point that can’t be ignored. Moraes himself points to alleged violations, destruction of an ankle monitor, and flight risk as factors that, in any normal case, would rule out home detention. And yet, he grants it. So were those violations real to begin with? It’s hard to see any consistent standard here. This doesn’t look like a coherent application of the law.
And all of this is happening as the political winds shifts, with @FlavioBolsonaro rising quickly in the polls ahead of the October 2026 presidential elections in Brazil. It looks like Moraes sees where things are heading and doesn’t want to be the one held responsible if something happens to Bolsonaro.
