Former medical student Daniel McFarlane , convicted of raping Ellie Wilson twice and attempting to defeat the ends of justice, has been granted parole.

The institutional disregard for the victim was made clear when Ms Wilson was completely banned from attending McFarlane’s oral parole hearing.
The Parole Board for Scotland upheld an objection from the rapist's legal team, effectively locking the survivor out of the process.
The Offender’s Veto: - McFarlane successfully blocked Ms Wilson from observing the hearing simply by objecting to her presence.
Institutional Rigidity: - The board previously scheduled a critical hearing on Valentine’s Day.
Despite Ms Wilson’s appeals for basic human compassion to move it from a highly distressing anniversary, the board flatly refused.
Secrecy and Isolation: Kept entirely in the dark, Ms Wilson was not allowed to watch the proceedings.
Instead, she was informed that her attacker would be released via a routine phone call.
The decision to grant McFarlane parole highlights a systemic issue where the comfort, privacy, and demands of a convicted sex offender are treated as a priority over the victim’s right to transparent justice.
Before being banned entirely, Ms Wilson was told she would have to sign a strict gagging order just to watch the public process a move she condemned as an attempt to protect her attacker’s privacy while silencing her own voice.
By allowing an offender to dictate who can witness his rehabilitation assessment, the justice system effectively shields the criminal from the reality of his actions.
This creates an environment where, as Ms Wilson stated, "rapists have more rights than victims."
The timing of the release adds further distress to the situation.
In 2025, the parole board blocked McFarlane's early release because he demonstrated a "profound lack of understanding" regarding his crimes, warning that other women would remain at risk until his behavior was addressed.
Remarkably, just over 12 months later, the board reversed its stance, claiming his risk "can be managed safely in the community" via geographic exclusion zones and licence conditions until 2027.
This case highlights why grassroots campaigns and organisations like Rape Crisis Scotland are demanding immediate legislative overhauls.
The current system leaves survivors to navigate a confusing, exhausting process that triggers fresh anxiety at every turn.
True justice reform must strip offenders of the power to veto their victims' presence, establish complete transparency in decision-making, and ensure that a survivor's psychological safety is never again sacrificed for a criminal's comfort.
