Landowners should not have to guess whether their property is subject to federal regulation.
The Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers proposed updated rules defining which waters qualify as “waters of the United States,” commonly known as WOTUS, under the Clean Water Act.
The agencies’ supplemental proposal follows the Supreme Court’s 2023 decision in Sackett v. EPA, which narrowed the scope of federal authority over wetlands and clarified the standards for determining which waters fall under the Act.
MSLF filed comments urging the agencies to translate that decision into clear, objective, and workable regulations.
The goal is straightforward: federal agencies should apply the law consistently, use reliable evidence when determining whether a water is federally regulated, and provide landowners with a meaningful explanation of why their property falls within federal jurisdiction.

Mountain States Legal Foundation has filed a new amicus brief with the U.S. Supreme Court in a case challenging the Environmental Protection Agency’s authority to revise national air-quality standards.
MSLF is asking the Court to review whether the EPA can revise these standards earlier or more frequently without following the “thorough review” process required by federal law.
The outcome could have significant implications for Western states, where federal air-quality standards affect energy, mining, agriculture, infrastructure, forest management, and other natural-resource activities.

Mountain States Legal Foundation has filed a new amicus brief with the U.S. Supreme Court in Alaska Policy Forum v. Alaska Public Offices Commission.
The case raises important First Amendment questions about whether nonprofits can be forced to register as campaign groups, report their expenditures, and publicly name their largest donors simply because they speak about an issue that later appears on a ballot.
MSLF is urging the Supreme Court to protect the right of organizations and their supporters to engage in public debate without unnecessary government intrusion into their private associations.

Yesterday, the Ninth Circuit Court of Appeals in Diemert v. City of Seattle granted a partial victory to Joshua Diemert. Joshua Diemert worked for the City of Seattle when the city rolled out its sweeping “Race and Social Justice Initiative” (RSJI).
In yesterday’s ruling, the Ninth Circuit Court of Appeals concluded that the workplace incidents Joshua Diemert experienced were “sufficiently numerous, frequent, and severe to create a triable issue as to the existence of a racially hostile work environment.” The court expressly recognized that race-conscious workplace training programs may violate Title VII when they create a racially hostile work environment.

At 14 years old, Israel “DT” Del Toro lost his father. Before he died, his father asked DT to make a promise:
“Take care of your brothers and sisters.”
DT has spent his life keeping that promise.
He carried it into the U.S. Air Force, where he served as a special operations paratrooper and put his life on the line for his fellow service members. Then, in Afghanistan, a roadside IED changed everything. DT suffered burns over 80 percent of his body, spent three months in a coma, and nearly died three times.Doctors didn't expect him to walk again. DT proved them wrong. He became the first 100% disabled veteran to reenlist in the Air Force, and his commitment to protecting others never stopped.
A Patriot’s Promise is the story behind the man, the soldier, and the fight. It is a powerful story of courage, sacrifice, resilience, and one promise that shaped an extraordinary life.
Meet the man behind the case. Read his story.

Happy Constitution Day!
Today, September 17th, we celebrate the signing of a document that changed the course of history and continues to protect the freedoms we cherish every day: the United States Constitution.
For 239 years, the Constitution has stood as a promise that our rights belong to us and that government must respect the liberties of the American people.
At Mountain States Legal Foundation, we are proud to be the Constitution’s lawyers. Since 1977, we have carried that promise into courtrooms across the country, defending the rights that make our free country possible.
Every case is different. Every courtroom brings a new challenge. But our purpose remains the same: to keep the Constitution strong and its promises alive.
Happy Constitution Day!
Here’s to 239 years of the Constitution — and to many more generations of Americans living free under its protection.
Twenty-five years later, we still remember.
On September 11, 2001, our nation experienced an unimaginable tragedy. Nearly 3,000 innocent people lost their lives, leaving behind families, friends, colleagues, and communities forever changed.
Today, the Mountain States Legal Foundation pauses to remember and honor every life lost that day.
We remember the men, women, and children who never made it home.
We remember the firefighters, police officers, first responders, and ordinary Americans who ran toward danger to help others.
We remember the families who were forced to say goodbye far too soon, and the countless people whose lives were forever changed by the events of that morning.
And we remember the extraordinary courage, compassion, and unity that emerged in the days that followed.
Twenty-five years may have passed, but the lives lost on September 11 have not been forgotten. Their stories remain part of our nation's story, and their memory reminds us of the preciousness of life, the strength of the American people, and the freedoms we are entrusted to protect.
