His lawyer advised him to do so out of prudence because of pending criminal investigations into the company related to Medicare billing practices. Scott repeatedly stated a version of: “Upon advice of counsel, I respectfully decline to answer the questions by asserting my rights and privileges under the Fifth Amendment of the U.S. Constitution,” including on basic questions such as whether he was a current or former employee.

We just got back from Lochiel on the Arizona-Sonora border, where DHS is demolishing ancient cottonwood trees that are older than the border itself to clear a path for the wall.

People have gathered to sit in the last remaining tree that contractors have targeted. Yesterday, one person was arrested.

These cottonwoods provide crucial habitat for birds and wildlife. I'm told an endangered yellow-billed cuckoo has been frequenting the last tree standing.

We (Center for Biological Diversity) are actively suing DHS for issuing legal waivers that bypass all environmental laws for border wall construction. Because people and wildlife in the borderlands deserve the same protections that exist everywhere else in America.

APPLEBAUM: Trump is using tools of American power to enrich himself and his family. That's real, profound abuse of American power.

For example, when Witkoff and Kushner were negotiating with Russians over war in Ukraine, they weren't negotiating on behalf of America.

They weren't negotiating in order to bring security to Europe, which is America's strongest ally, where lot of American companies do business.

They weren't negotiating on behalf of Ukrainian people, who have been, objectively speaking, the victims of horrific attacks.

They were negotiating in order to do business deals for maybe companies associated with them, but certainly other American companies.

And they were talking directly to Russians who were promising them mineral deals and oil and gas deals.

Devon Archer was convicted by a federal jury of helping defraud the Oglala Sioux Tribe’s business arm out of $60 million in worthless bonds. He owed $43.4 million in restitution and $15.7 million in forfeiture. The Supreme Court refused to hear his appeal.

Trump pardoned him. And the White House explained why out loud: the case against Archer changed, they said, after he became a witness against the Biden family.
