Prof., you were once a professor of law and ought to know the reason people approach courts is to correct a wrong done to them. Even Uhuru and Ruto had been declared President and Deputy President elect, respectively, and the Supreme Court nullified their election. The order of SCOK in 2017 came after the declaration of a win.
