#MEDIABRIEFING| ON THE SECTION 89 MATTER
• The ANC’s position on the Section 89 process is one of procedural neutrality, supporting a fair, orderly and constitutional parliamentary process without prejudging the merits of the matter.
• The ANC believes an inquiry of this nature must rely on tested evidence under oath, not unverified hearsay, to protect the integrity of Parliament and ensure a fair process.
• The ANC notes that the findings of the Public Protector and the South African Reserve Bank form part of the broader context that Parliament should consider as it deliberates on the matter.
• The ANC believes it would be prudent for Parliament to await the outcome of the September court proceedings before taking further steps, ensuring legal certainty and safeguarding the integrity of the Section 89 process.
[WATCH] The Democratic Alliance opposed the establishment of the Border Management Authority when the ANC took it to Parliament. Today, it wants to present itself as the champion of secure borders.
The ANC is not shouting from the sidelines. A Bill before Parliament will require asylum seekers to seek protection in the first safe country they reach, strengthening our asylum system while protecting genuine refugees.

#MEDIABRIEFING| SETTING THE RECORD STRAIGHT — TWO DECADES OF ACTION ON IMMIGRATION
• The ANC rejected claims that government has done nothing on illegal immigration, highlighting that hundreds of thousands of undocumented foreign nationals have been lawfully deported over the past two decades, with enforcement intensifying in recent years.
• The ANC noted that several government immigration decisions have been challenged and overturned by the courts, demonstrating that enforcement has often been limited by constitutional and legal rulings rather than a lack of political will.
• The ANC emphasised that it established the Border Management Authority to strengthen border security and continues to implement reforms to improve immigration enforcement, despite opposition to these measures.
• The ANC supports legislative reforms, including the First Safe Country principle, to prevent abuse of the asylum system while protecting genuine refugees, ensuring that immigration is managed through the rule of law rather than vigilantism.
