Killing two human beings while drunk is anything but non-violent.
But in California, someone convicted of driving drunk and injuring someone would actually spend more time behind bars than a driver who kills while under the influence.
A disgusting fact that the Orange County District Attorney’s Office has repeatedly tried to correct, lobbying for stronger laws to prevent DUI drivers from being eligible for additional credits to enable early release, and to increase punishment for DUI drivers who kill someone.
Orange County District Attorney Todd Spitzer is honored to co-sponsor SB 907 with Los Angeles County District Attorney @NathanHochmanDA. Authored by @SenBobArchuleta (D-Pico Rivera) who tragically lost his eldest grandchild to a drunk driver, SB 907, will strengthen California’s DUI enforcement and sentencing laws, particularly for repeat offenders.
SB 907 includes:
• Longer sentences for drunk drivers who kill multiple people: “Kolya and Anya’s Law” allows full-term consecutive sentencing for multiple violations of gross vehicular manslaughter and vehicular manslaughter while intoxicated (creating an exception to the “volume discount” or 1/3 the mid-term rule for consecutive sentences). Named for 19-year-olds Anya Varfolomeev and Nikolay Osokin, who were tragically killed in Orange County by an illegal immigrant previously deported twice, driving over 100 mph while drunk and high in 2021. Their killer served just 3½ years of a 10-year sentence because under current law he was considered a “non-violent” offender and eligible for early release. SB 907 fixes that.
• Braun’s Law: Mandatory Watson warnings for hit-and-runs that are pled down from a DUI. Mirrors existing law for wet reckless pleas. Named for 18-year-old Braun Levi, killed by a repeat drunk driver in Manhattan Beach.
• Adds gross vehicular manslaughter and vehicular manslaughter while intoxicated to the violent felony list in PC 667.5(c).
• Targets repeat offenders: Adds a 3-year enhancement for a prior felony DUI conviction with a new felony DUI (with a 10-year washout).
• Increases punishment for hit-and-run and hit-and-run with injury if the driver has a prior DUI conviction within 10 years.
“Life is such a precious gift that must never be taken for granted, yet when a driver under the influence takes a life, California laws have fallen short in being able to hold those drivers accountable in a way that values the true tragedy of a death caused by drunk or drugged driving,” according to Orange County District Attorney Todd Spitzer. These drivers are not just taking a single life through their selfish actions; they are creating a ripple effect of death and devastation across families, workplaces, neighborhoods, and entire communities who grieve the loss of a loved one who should still be here on earth.
“Everyone knows about the deadly dangers of impaired driving, and yet countless families continue to be destroyed because someone gets behind the wheel after drinking or using drugs. We as Californians must stand up against drunk and drugged driving by demanding full accountability for impaired drivers and the shattered lives they leave in their wake. Thank you to Senator Archuleta for continuing to lead the charge against impaired driving in the hopes of saving priceless lives.”
California’s creative concoction of good time, education, and other credits has resulted in criminals being released quicker than ever before. SB 907 will keep drunk drivers off our streets - and behind bars where they belong.
