In the 1960s, a case went to Supreme Court against a man winning an MLA election from a Scheduled Caste-reserved seat despite having converted to Christianity

The facts of the case were:

- S Rajagopal was born into a family of Adi Dravidas - an SC caste in Karnataka
- He received free schooling because of his caste
- For college, he converted to Christianity in 1949 and got secured admission to Woorhees High School and the associated Woorhees Christian Hostel
- He converted at the Ponnai Anicut Festival, a three-day celebration organised by the Church of South India and held for over 130 years

But in 1967, he hid his conversion to contest the Kolar Gold Fields constituency, which was reserved for SCs

He won

His rival, CM Armugam, took the case to court

Before the court, Rajagopal first claimed that he had never converted

However the other side produced documents:

- his admission to the hostel, which was meant only for Christians
- his baptism certificate
- the college’s admission register where he had recorded himself as a Christian
- his service records, which also recorded the same
- witnesses who testified that he regularly attended church

The Supreme Court said:
“When [Rajagopal] embraced Christianity in 1949, he lost the membership of the Adi Dravida Hindu caste.”

Rajagopal then claimed that he had returned to Hinduism

Supreme Court did not find merit in his claim and held his election to be void

Election on that seat was held again

And this is how the case dragged on for months and substantial public resources were spent because the Returning Officer did not reject Rajagopal’s candidature at the nomination stage itself, despite objections raised by Armugam and others

The situation is the same even today
