The state is asking the court to require Brenntag to submit a plan to eliminate surface water discharge and clean up past discharge and contamination within 30 days.
Today, AG @JeffJacksonNC sued on behalf of @NCDEQ to stop Brenntag Mid-South from continuing to illegally discharge contaminants into state waters from its Durham facility and to act immediately to clean up the damage it's caused. https://t.co/NT9wr4ejZn
After receiving complaints about the facility in April 2025, DEQ visited the site and saw that Brenntag's practices were allegedly violating NC's water quality standards and contaminating several waterways that impact a local elementary school and park.
The brief argues courts should evaluate alleged anticompetitive conduct in its entirety instead of examining actions piece by piece. Considering the broader pattern of a company's conduct is key to determining whether it unlawfully harmed competition and consumers.
