"Palestinians are illegally occupied"
No. The occupation is not “illegal” as a blanket statement, it is disputed, and the correct framing depends on which part of the territory you are talking about and which legal basis you apply. If you want the blunt, expert, fact-first answer without the activist slogans, here it is.
1. There is no international court ruling that the occupation itself is illegal
People repeat this line because it sounds powerful, but no competent judicial body has ever ruled, “Israel is illegally occupying Palestinian land.”
The International Court of Justice has issued advisory opinions, not binding rulings. Advisory opinions carry political weight, not legal force.
2. The correct legal term is belligerent occupation, which is lawful
Under the Fourth Geneva Convention, occupation after war is legal.
Israel gained control of the West Bank and Gaza in 1967 after being attacked by Jordan and Egypt.
A territory captured in war is lawfully occupied until a final political settlement occurs.
3. What is disputed is sovereignty, not the legality of occupation
The West Bank was never a sovereign Palestinian state.
It was illegally annexed by Jordan in 1950, and the international community never recognized Palestinian sovereignty over it.
If sovereignty is not established, you cannot “illegally occupy” someone’s state.
4. The only aspect widely considered illegal is civilian settlement expansion, not the occupation itself
Even here the legal arguments are mixed.
Most states view settlements as violating Article 49(6) of the Geneva Convention.
Israel argues the article applies only to deportation and forced transfer, which it does not practice.
There is no binding ruling either way.
5. Gaza is not occupied in the legal sense
Since 2005 Israel has no military government, no settlers, and no administrative control inside Gaza.
It controls the border and airspace of a hostile entity, which does not constitute occupation under international law.
6. If Palestinians claim “illegal occupation,” they’re relying on political language, not legal rulings
It is a narrative framing, not a verdict.
Even the UN uses political terminology, not judicial ones, because the UN General Assembly is not a court.
The occupation is lawful under the laws of war, the territory’s sovereignty was unresolved, and no court has ruled otherwise. The word “illegal” gets thrown around because it wins propaganda battles, not because it reflects binding legal reality.
The ICJ advisory opinions are legally toothless.
