THE INCOME TAX (Significant Economic Presence Tax) Regulations, 2025.

Brace yourselves your online activities are about to experience some price changes.

The KRA has just published tax proposals targeting services carried out over the Internet, electronic network and Digital marketplace and the income derived from it by non residents.
This tax shall be applicable to
1. Downloadable digital content, mobile applications, ebooks.
2. Subscription Films like Netflix, subscription based media including news and magazines.
3. Electronic data management.
4. cloud computing.
5. Streaming, audio visual online content, 6. ticketing services for events.
7. Services that link supplier to recipient like taxi hailing services. Rental and accommodation services like Airbnb. 8. Artifical intelligence help desks chatgpt etc

The taxable computing shall be 10% of Gross Turnover
AND
The rate of tax shall be 30% of the deemed taxable profit.

These regulations target all organisations trading or providing services over the Internet where the recipient is domiciled in Kenya or has an access point in Kenya unless exempt. Shall not be applicable if the 'business' is domiciled in Kenya.

You can channel your submissions to the commissioner General via [email protected] to be received on or before 7th October, 2025.
