The application was for the return of the minor children to Germany in terms of article 12 of Chapter III of the Hague Convention on the Civil Aspects of International Child Abduction.

It had nothing to do with custody - see article 19 of the Convention: a “decision under this Convention concerning the return of a child shall not be taken to be a determination on the merits of any custody issue”
