Doctors want to perform a brain death exam on Annelise Camp. Part of this exam is the apnea test, in which Annelise will be disconnected from her ventilator for ten minutes or more and observed for spontaneous breathing.

The apnea test, part of the American Academy of Neurology’s (AAN) brain death examination, can increase brain damage and entails significant risks.

The apnea test is unverified, and even the AAN Guideline states that there is a lack of scientific evidence to support the recommended parameters of the apnea test.

In describing the parameters for the apnea test, the Guideline states: “Selection of targets for this challenge is arbitrary because no scientific data demonstrate specific PaCO2 above which medullary chemoreceptors would prompt respiration if they were functional.”

Dr. Alan Shewmon has published multiple cases of patients who failed to breathe during their apnea tests, but then began breathing after their support was withdrawn. Thus, the apnea test does not reliably achieve its goals.

In addition to being scientifically unverified, the apnea test is risky for a patient not yet known to be brain dead.

The Guideline lists the following risks of the apnea test: hypoxemia, hypotension, arrhythmias, pneumothorax, and hemodynamic compromise with cardiovascular collapse requiring cardiopulmonary resuscitation.

These types of complications are extremely detrimental for a neurologically injured patient with tenuous cerebral blood flow, and can cause further brain damage.

Incredibly, despite these risks, the Guideline states, “clinicians do not need to obtain informed consent,” for the apnea test except as required by local jurisdictions.

The apnea test has no benefit for the patient, does not accomplish its purpose, and can only cause harm —including brain damage and death. No patient with a neurological injury should have to undergo this unethical test.

Attorney General Paxton, you need to be aware that the way doctors diagnose brain death does not comply with the law under the Uniform Determination of Death Act (UDDA).

The UDDA requires the irreversible cessation of all functions of the entire brain including the brain stem.

The American Academy of Neurology’s (AAN) brain death diagnosis guideline explicitly allows brain death to be declared in the ongoing presence of brain function.

Because the AAN was aware that their guideline didn’t comply with the law, they petitioned the Uniform Law Commission (ULC) to change the UDDA to make it comply with their guideline.

I was an observer to the Uniform Law Commission as they met to discuss revising the UDDA. At their annual meeting in Hawaii in 2023, I remember one lawyer wondering why they were being asked to change the law in order to accommodate doctors who were not complying with it? His suggestion was that doctors should be required to follow the law.

The ULC could not reach consensus and tabled their efforts to change the UDDA in September 2023.

Thus, doctors are continuing to diagnose people with continuing brain function as being “dead.”

Dr. Michael Nair-Collins sums it up this way: “People who are not dead under the law that defines death should not be declared dead. There is no compelling reason to continue the practice of declaring legally living persons to be dead.”

I have refrained from talking about Henry Nowak so far because I was too angry. I remain too angry.

I'm angry at the scumbag who stabbed an 18-year-old boy to death. Who drove a blade into the back of his legs to stop him from running, then finished him by skewering him through the chest with an 8-inch blade. All while that poor boy tried desperately to escape.

I'm angry that the same scumbag then cried "racism" to cover his tracks, claiming self-defence after pursuing and butchering an innocent boy who just wanted to get home.

I'm angry at the judge who has introduced manslaughter as an alternative verdict before the jury even had a chance to decide. Robbing Henry's family of the proper verdict on what was clearly cold-blooded murder.

I'm angry at a nation that grants religious exemptions so minorities can carry deadly blades in public while locking up natives for far less. A nation that has opened the floodgates to migrants who want us dead and now watches its own young bleed out in the name of "diversity."
