Who owns the beach? @NPR's @NPRDebElliott reports on the decade-long fight over customary use along Walton County's 26 miles of Gulf shoreline, where no-trespassing signs, private security, and a shifting set of state laws have left beachgoers and homeowners guessing at the property line.
Holtzman Vogel's Kent Safriet has represented roughly 80 landowners in that fight, which began with the county's 2016 customary use ordinance and ran through the 2018 state law requiring Walton County to prove customary use in court.
Kent's position is a Fifth Amendment one. Because no private property can be put to public use without just compensation, he told NPR, the English doctrine of customary use would be unconstitutional in America. He also makes a simpler point about what the dispute is really about, which is control, and notes that owners hold the same rights on the sand behind their homes that county commissioners hold in their own front yards.
