I think that’s one of the biggest flaws behind these televised trials. On one hand, it is nice to have everything clearly documented. On the other hand, it becomes a public spectacle and public opinion sways the jury more often than not. If they knew they could make a community decision in anonymity, they might be more likely to choose a just verdict. Instead, they feel pressured by the media and the public to just slap a guilty on to quell the bloodlust of the masses. The whole process needs a complete overhaul.
This is exactly the problem. Even after an exoneration, states don’t take accountability for their failures or try to find the right answer. #wrongfulconvictions
Everyone does understand why the CW had no choice but to proceed to trial against Karen Read, right? For those of us watching and see nothing to suggest O'Keefe was killed by a car, we might be wondering why the CW ever brought this case.
For me, it seems somewhat obvious. The CW doesn't have to win this trial to "win." If indeed this is a huge police coverup, the CW doesn't have to win this trial. It just has to do its best to sway public opinion that Karen Read must have done it.
Follow this to the end. Let's say she is acquitted. So what? There will still be lots of people who will forever believe she did it. They will say things like, "an acquittal doesn't mean you're innocent."
And when the CW doesn't implicate anyone else, the prosecutor can rest on this: "We had the right person, but the jury saw otherwise." In this way, those involved in a coverup are NEVER held accountable.
I see this all the time in wrongful conviction cases. You get someone exonerated, and the prosecutor says, "We aren't going to reopen this case. We had the right person. This new evidence proves nothing."
