Video shared with KUTV by Brad Aukschun shows a Utah Department of Public Safety helicopter on the summit of American Fork Twin Peaks following a fatal lightning strike Saturday in Little Cottonwood Canyon.

Aukschun said he was at the top of the Snowbird tram when he recorded the helicopter. He had been attending the Wasatch Wildflower Festival, which drew large crowds to the resort for guided hikes and family activities.

"I was inside the summit restaurant when some employees rushed out after a lightning strike," Aukschun said.

He said the helicopter circled the peak several times before leaving, then returned a short time later.

Aukschun also said the festival brought a large number of visitors to the mountain as storms moved into the area.

"It was crowded for the festival and employees went down the trail on side-by-sides to retrieve people trying to get out of the weather between the Peruvian lift and the Tram," he said.

🚨BREAKING UPDATE OUT OF MAINE: The man killed in the Biddeford, Maine ICE shooting has been identified as a 26-year-old Colombian man who was authorized to work in the United States and had been issued a Social Security number.

This wasn’t a “violent criminal.” This wasn’t even an undocumented immigrant.

This was someone who had legal authorization to live and work here.

So why was ICE trying to pull him over?

A witness also says he saw a large white vehicle ram the smaller vehicle, followed by a second impact… And heard gunshots.

He says he then saw an officer open the vehicle door, pull a man out with blood covering his head, and heard him say: “I tried to stop.”

ICE agents do not have the authority to stop whoever they want, give conflicting orders, escalate an encounter, and then use deadly force when that situation becomes chaotic.

If the government gives agents the power to carry weapons and take someone’s life, those agents have a responsibility to make sure they are acting within the law before they create a situation where someone can be killed.

A person’s rights do not disappear because an ICE agent decides to stop them.

Which means the question that must be answer is this…

Was this man killed because ICE created a dangerous situation that never should have happened?

Because when the government can put someone in a life-or-death situation, the question cannot only be whether the final seconds justified pulling the trigger.

We have to ask why this encounter was allowed to escalate in the first place.
