@TeamYouTube My counter notification has been falsely rejected. I've been on the platform for a good while now to know this isn't right. I have used the EXACT reasoning in my counter notifications in literally ALL of my copyright battles. And not ONCE when a person from YouTube actually looked at my case has it been refused. I've included below the reasoning I use, and as you can see its all for the same cases.
I am submitting this counter-notification because I believe the takedown of my Pokémon manga videos was made in error. My videos fall under fair use as defined by Section 107 of the Copyright Act of 1976. The content I uploaded is transformative in nature and does not act as a replacement or alternative to the original manga. The videos provide commentary and explanation, with the original material serving only as visual reference to support my points. To ensure compliance with copyright guidelines, I purposefully blot out manga panels, making them entirely illegible as well as adding screen tones. This prevents the content from serving as a substitute for the original work as well as forcing viewers to focus on my commentary above all else I also feature my own thoughts and opinions in these videos on the content I'm talking about Furthermore, I consistently remind my audience that my videos are not an alternative to the official material and encourage them to support the creators by purchasing the original manga. Under the fair use doctrine, content used for criticism, commentary, and educational purposes is protected. My videos meet these criteria and do not harm the market for the original work. I respectfully request that my videos be reinstated, as they clearly fall within the bounds of fair use. Thank you for your attention to this matter.
You guys even even emailed saying my counters were forwarded then days later replied to your email and said that now its been rejected,
Your copyright team has continued to refuse to forward my counter notification to the claimant. All while YouTube continues to INSIST they do not mediate in copyright disputes. The definition of mediate by the way is, “intervene between people in a dispute in order to bring about an agreement or reconciliation”. You are LITERALLY doing the EXACT DEFINITION OF MEDIATION! It is not for YouTube to decide what is and is not fair use. That is a matter for the courts to decide. You are interfering with the proceedings of a legal battle you have no standing in.
Every time a rejection is sent it is literally the same copy and paste reply, tells me or at the very least gives the impression that there isn’t a person actually checking my case, and it is being auto rejected regardless of how much of an injustice it is. If I TRULY do not have the legal rights to dispute this claim and my reasoning is not sufficient then please share with me EXACTLY what is lacking where previously it was not. That clarity will not only help me but the hundreds of other creators who make similar videos.
I have attached 3 screenshots of emails from the past where I used the above reasoning one of which was for a video that was supposedly forwarded then changed to rejected and also 1 of the current email. YouTube had no issue in sending it to the claimant. So please explain to me CLEARLY why now it’s all of a sudden not enough. For the record I have dozens if not hundreds of examples of these emails for various videos.
