BREAKING: USCIS just changed how green cards inside the US are decided. Policy Memo PM-602-0199 (May 21, 2026) calls adjustment of status โextraordinary reliefโ โ not the default path. What it means for F-1, H-1B, L-1, O-1, EB-1A and EB-2 NIW. Thread
What the memo does NOT do: โ Eliminate AOS โ Change Form I-485 โ Set an effective date โ Address pending cases โ Override dual intent BUT: USCIS may issue category-specific or population-specific memos next. Watch carefully.
DUAL INTENT IS PRESERVED: โ H-1B โ still works for AOS โ L-1 โ still works for AOS โ O-1 โ still works for AOS BUT: dual intent alone is NOT enough to guarantee approval. You still need a strong discretionary case.
The new standard for adverse factors: If you violated status, overstayed, worked without authorization, or acted inconsistent with your visa purpose, you may need to show โunusual or even outstanding equitiesโ โ Matter of Blas (BIA 1974), cited in the memo.

If you ALREADY moved to H-1B or green card: The past does not disappear. ICE can flag prior OPT employment years later. That can affect H-1B extensions, I-485 adjustment, and inadmissibility under INA 212(a)(6)(C). Clean records protect your future.
