According to a recent report by Chainalysis, crypto crime in 2023 experienced a significant decline, with illicit activity dropping and cybercriminals shifting their focus toward stablecoins. The value of crypto sent to illegal addresses decreased by 39% from $39.6 billion in 2022 to $24.2 billion last year. This decrease was accompanied by a drop in the percentage of all crypto transaction volume associated with illegal activity, down from 0.42% to 0.34%.
The report also reveals that stablecoins have now surpassed Bitcoin as the preferred currency for illicit transactions due to their stability and ease of use. However, the dominance of stablecoins varies depending on the type of crime, with Bitcoin still being the primary currency for darknet market sales and ransomware extortion. Scamming and stolen funds experienced significant declines, down by nearly 30% and 50% respectively, while revenues from ransomware and darknet markets actually increased. Surprisingly, transactions linked to sanctioned entities accounted for over 60% of all illicit activity.
Although these figures offer some relief, it is important to note that they are only lower bound estimates as new illicit addresses continue to be discovered. Therefore, caution should be exercised in interpreting these results as a definitive victory against crypto crime.
Former IcomTech CEO, Marco Ochoa, has been sentenced to five years in prison for wire fraud. This follows his guilty plea for conspiracy to commit wire fraud in a crypto-based Ponzi scheme at IcomTech. Ochoa, who served as CEO from 2018 to 2019, will also forfeit $914,000 and begin his 60-month sentence on March 19, with two years of supervised release. The company, which promised daily returns to investors but collapsed three years ago, was described as a large-scale copycat cryptocurrency scam.
JPMorgan analysts have expressed doubt about the Securities and Exchange Commission approving an Ethereum spot exchange-traded fund (ETF) by May. While there are arguments supporting Ether's classification as a commodity, the regulatory uncertainty surrounding ETH could delay its approval. Recent lawsuits against Binance US and Coinbase, as well as the SEC chairman's refusal to confirm ETH as a security, add to the uncertainty. Although the 50% chance of approval is significant compared to previous years, a positive outcome could lead to significant price growth for ETH in 2024 and beyond. However, there is a possibility of a pullback in Ethereum prices similar to what happened with Bitcoin after its spot ETF approval.
BlackRock, the multi-trillion-dollar asset manager, has stated that it has no immediate plans to create a spot XRP ETF, disappointing many in the crypto community. This decision comes in light of the regulatory ambiguity surrounding XRP, with a recent ruling declaring it an unregistered security for institutional buyers. The lack of legal clarity, along with the potential for an SEC appeal, makes it risky for asset managers like BlackRock to launch XRP ETFs. Previous speculation was sparked by BlackRock CEO Larry Fink's cryptic response on the topic, but it seems that hopes for a US XRP ETF have been dampened.
Ripple's general counsel, Stuart Alderoty, has criticized the SEC's approach to digital assets, stating that their current stance on crypto assets is divergent from established law and bordering on the absurd. He argues that comparing investing in crypto assets to investing in an ecosystem of oranges is a view that would have been dismissed in earlier times. On the other hand, Coinbase argues that digital tokens should not be subject to the same regulatory framework as traditional investment contracts, considering them more akin to collectibles. The outcome of this disagreement will be pivotal in defining the SEC's jurisdiction over the crypto sector.
The US federal appeals court has ordered the appointment of an independent bankruptcy examiner to investigate the collapse of FTX, the cryptocurrency exchange. This decision, reversing a prior ruling, comes after the alleged misappropriation of $10 billion in customer assets, which has significant implications for FTX's global investors and the cryptocurrency industry. The court emphasized the need to protect debtors and creditors in FTX's Chapter 11 reorganization, highlighting the losses suffered by investors and the broader implications for the sector. While some oppose the appointment, citing duplication of efforts and high costs, this move highlights the importance of regulatory safeguards and raises questions about the industry's resilience. With FTX's former CEO facing conviction and sentencing, the examination of this case adds complexity to the situation and underscores the need for transparency and accountability in the cryptocurrency industry.
The Third Circuit Court of Appeals has ruled that FTX must be investigated by an independent examiner, as requested by the U.S. Trustee overseeing the FTX bankruptcy. The court believes that the current CEO's investigation is not enough and that an independent probe could reveal important insights into industry practices. The examiner should not have any personal interest or involvement with FTX. The appointment of an examiner is required by the Bankruptcy Code when a debtor's debts exceed $5 million, which is the case with FTX. This investigation could shed light on FTX's use of its own cryptocurrency tokens to inflate its value and bring attention to undisclosed credit risks in other crypto companies.
The past week in decentralized finance (DeFi) witnessed significant market developments, such as Wormhole reclaiming $1 billion in total value locked in its bridge, and the Hedera Governing Council approving $408 million of HBAR for ecosystem growth. However, the top-100 DeFi tokens had a bearish week, with most trading in the red. On a positive note, Fidelity suggests that an anticipated interest rate cut by the US Federal Reserve could lead to increased institutional interest in DeFi and stablecoins, provided the infrastructure continues to develop. Additionally, Avalanche inscription tokens drew significant investor interest, and the Wormhole bridge's total value locked has recovered to $1 billion, marking a substantial increase since the beginning of the year. In the realm of decentralized exchanges, dYdX's Cosmos-powered market surpassed Uniswap in daily trading volume. Overall, despite a bearish week for DeFi tokens, the sector's total value locked remains above $65 billion. Stay tuned for more updates on the rapidly evolving DeFi space next week.
Grayscale CEO, Michael Sonnenshein, has cautioned that the majority of spot Bitcoin ETFs approved by the SEC will not survive in the long run. Despite Grayscale's higher fees, Sonnenshein argued that their extensive track record and position as the largest Bitcoin holder among ETF providers demonstrate their long-term commitment. He suggested that only two or three spot Bitcoin ETFs will eventually succeed. It is worth noting that the price of Bitcoin has dropped by over 17% since the launch of the first U.S. spot BTC ETFs.
The recent security breach exposing a false approval of a Bitcoin ETF by the SEC has sparked criticism towards Chairman Gary Gensler. Many on Wall Street view his actions as ambitious and believe he has overstepped his bounds. Gensler's pledge to bring stricter rules for crypto and stock markets has resulted in lawsuits and challenges to the SEC's mandate. Moreover, his intention to crack down on the use of AI has raised concerns about concentration of power. Ripple Labs CEO, Brad Garlinghouse, has called Gensler a political liability, citing the SEC's unsuccessful cases against Ripple and the mischaracterization of other crypto companies. Gensler's position as SEC chair may be in jeopardy, depending on the outcome of the 2024 election.
Ripple CTO David Schwartz has addressed concerns regarding the initial distribution of XRP, particularly focusing on events at Genesis. He clarified that there were no transactions included in the Genesis block, and out of the missing 32,570 ledgers, only 534 had transactions. Notably, the founders received 20% of the total supply, with the majority (99.99%) going to the company, Ripple. The remaining 0.013% was allocated to Beta testers and developers. This information sheds light on the XRP distribution process and explains why Ripple holds a significant portion of the supply. Currently, the company releases one billion coins monthly, keeping 200 million for operations and returning 800 million to escrow.
