Imagine applying this logic anywhere else. If three teenage boys carried out a series of armed burglaries, filmed themselves waving knives, and shared the footage online, nobody would blink if they were sent to secure detention.

Yet with rape – a crime that obliterates a victim’s sense of safety and self – the system suddenly decides custody is a “last resort” and that the real danger is “criminalising” the offenders.

The Sentencing Council paperwork is full of reassuring words about public protection and the option of grave‑crime detention for serious sexual offences, but in practice judges bend over backwards to keep even egregious cases in the rehabilitation box.

That’s how you end up with ten counts of rape across two victims in Fordingbridge and still no prison.

And because there are no serious political consequences – no judge removed, no minister resigning, no wholesale review of youth sexual‑offence sentencing – the signal to the wider system is clear: keep doing what you’re doing, the public will shout for a few days and then move on.
